WARRANTY POLICY

1. DISCLAIMER

  1. a.) Berria product warranty policies are limited to new Berria / Avanforce products, including bicycles and accessories purchased through authorised Berria distributors.
  2. b.) Berria/Avanforce accessories and bicycles must be assembled and fitted by authorised Berria distributors. Damage, injury or breakdowns caused to bicycles and/or cyclists where the bicycle was assembled by unauthorised Berria distributors will not be covered by Berria's warranty policies.
  3. c.) Berria encourages all new owners of Berria bicycles to register their new bicycle via the Berria website: https://berriabikes.com/pages/garantia-1
  4. d.) In the event of frame replacement, this warranty shall not cover the replacement of any component installed on the original bicycle that is incompatible with the product delivered by Berria, and the owner shall be responsible for the cost of any parts, accessories and/or components necessary for final assembly. In addition, the authorised Berria distributor may apply charges for: incident management, labour required for disassembly and subsequent assembly of the frame and/or fork or component.
  5. e.) Product registration allows Berria to contact all customers to provide them with further information about the products, including, but not limited to, the warranty and after-sales service, etc.
  6. f.) The colour of the frame or bicycle, specifications, accessories, etc., will be based on the current physical availability of the product. Berria reserves the right to make changes to the specifications and/or accessories.
  7. g.) Berria reserves the right to make changes to the product warranty policies, so it is recommended that you periodically review the website for updated information or contact your nearest authorised Berria distributor for more information.

2. WARRANTY TERMS AND CONDITIONS FOR BICYCLES

  1. a.) Berria warranty coverage is limited exclusively to the original owner.
  2. b.) Berria will provide replacement, repair or exchange of products at no cost if the defect in the product is caused by design, material or manufacturing, provided that it is within the warranty coverage period.
  3. c.) If applicable, Berria reserves the right to replace frames from the model year corresponding to the warranty or later.
  4. d.) Use in competition voids the warranty. Defects caused by misuse of the product, accident, natural disaster, normal wear and tear, etc., are not covered by the Berria product warranty. Berria may provide repair or replacement at a charge through Berria's after-sales service. Discolouration of fluorescent colours caused by prolonged exposure to UV rays (ultraviolet light) from sunlight is not considered a manufacturing defect.
  5. e.) Warranty coverage for bicycles and frames:
    1. e-1.) Berria lifetime warranty* on the bicycle frame, except for e-bike/enduro models, from the date of purchase by the consumer.
    2. e-2.) Berria rigid forks: 3-year limited warranty from the date of purchase by the consumer.
    3. e-3.) 1-year limited warranty from the date of purchase by the consumer on paint, decals, original Berria parts, excluding parts from other third-party distributors such as Shimano, SRAM, Fox, Mavic, Zipp, etc. Discolouration of fluorescent colours caused by prolonged exposure to UV rays (ultraviolet light) from sunlight is not considered a manufacturing defect.
    4. e-4.) Warranty coverage for parts from other third-party distributors will be provided by the respective distributors' brands.

3. CORRECTION AND REPAIR OF A WARRANTY FOR BICYCLES

  1. a.) The warranty procedure is limited to the repair and/or replacement of the affected part(s).
  2. b.) If the damaged part is no longer in current production, Berria will provide a replacement of equal or greater value, as the case may be.
  3. c.) If there is a shortage in the factory production of an original part, Berria will provide a credit note for the part to be replaced, or offer a product of higher value than the original where the consumer may choose to pay the difference for the upgrade.
  4. d.) Any warranty claim must be made solely and directly to an authorised Berria distributor.

4. ACCESSORIES WARRANTY TERMS AND CONDITIONS

  1. a.) Berria's warranty coverage is limited to the original owner.
  2. b.) Berria's own Avanforce brand components such as handlebars and seat posts will have a limited warranty period of 3 years from the date of purchase by the consumer.
  3. c.) Other Berria/Avanforce accessories and products included in bicycles, cycling accessories and service-related accessories will have a limited warranty period of 3 years as required by law, from the date of purchase by the consumer.
  4. d.) Berria will provide replacement, repair, or exchange of products at no cost if the defect in the product is caused by product design or material, provided that it is within the warranty coverage period.
  5. e.) Defects caused by improper use of the product, accident, natural disasters, normal wear and tear, etc., are not covered by the Berria warranty. Berria may provide repair or replacement at the customer's expense through Berria's after-sales service.
  6. f.) If a defect is found in new products and components, such defect shall be covered by the Berria warranty.
  7. g.) There is no warranty coverage for products and accessories such as consumables: tyres, inner tubes, handlebar tape, grips, brake pads, brake covers, gears, mudguards, wiring, brake fluid, etc. And for any component or accessory already used by the consumer in normal use or subject to normal wear and tear.

5. CORRECTION AND REPAIR OF AN ACCESSORY WARRANTY

  1. a.) The warranty solution is limited to the repair or replacement of the affected part.
  2. b.) If the damaged part is no longer in current production, Berria will provide a replacement of equal or greater value, as appropriate.
  3. c.) If there is a shortage in production at the factory of the original part, Berria will provide a credit note for the part to be replaced or will replace it with a part from another brand of equivalent value, or will offer a product of higher value than the original where the consumer may choose to pay the difference for the upgrade.
  4. d.) Any warranty claim must be made directly to an authorised Berria distributor.

6. PROOF OF PURCHASE

  1. a.) To verify the warranty coverage period, it is important to keep the original purchase receipt as proof of purchase.
  2. b.) For all bicycles, consumers can register their new Berria bicycles on the Berria website.
  3. c.) For all Avanforce components, it is important to keep the original purchase receipt.
  4. d.) If the original purchase receipt is not provided, Berria will not be able to provide warranty claim service.

7. WARRANTY EXCLUSIONS FOR BICYCLES AND ACCESSORIES

  1. a.) Bicycles and accessories purchased through an unauthorised distributor.
  2. b.) Bicycles provided for a professional cycling team where the cyclists on this team participate in competitive events or races.
  3. c.) Normal wear and tear on parts such as tyres, inner tubes, chains, drive belts, cartridges, brakes, cables, sprockets, handlebar tape, grips, brake pads, brake covers, gears, mudguards, baskets and their accessories, etc., where there are no defects in the material or installation.
  4. d.) Bicycles repaired by a distributor other than an authorised Berria distributor.
  5. e.) Modifications and/or alterations to the original model. For example: repainting.
  6. f.) The use of the bicycle or accessories in abnormal, competitive and/or commercial activities or for purposes other than those for which the bicycle or accessory was designed.
  7. g.) Failure to follow the user manual, including failure to provide adequate and timely service and maintenance.
  8. h.) Paint finish and damage to decals resulting from participation in competitions, jumps, descents and/or training for such activities or events, or as a result of exposing the bicycle to severe conditions or extreme weather.
  9. i.) Accessories and parts with corrosion or discolouration resulting from exposure to sweat, knocks or impacts, improper storage conditions or natural wear and tear.
  10. j.) Defects occurring due to natural disasters or force majeure.
  11. k.) Berria does not provide any other type of warranty service, whether express or implied. All implied warranties, including commercial warranties and warranties of fitness for a particular purpose, are limited in duration to the express warranties mentioned above.
  12. l.) Other third-party components will receive a warranty period established by the manufacturer from the date of purchase.

Notwithstanding the foregoing, the legal warranty established by Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, shall apply.

In particular, the legal warranty provided for in Article 120 applies:

  1. In the case of a contract for the sale of goods or the supply of digital content or services supplied in a single act or in a series of individual acts, the trader shall be liable for any lack of conformity which exists at the time of delivery or supply and which becomes apparent within three years of delivery in the case of goods or within two years in the case of digital content or services, without prejudice to the provisions of Article 115 ter, paragraph 2, letters a) and b).
  2. In the case of second-hand goods, the trader and the consumer or user may agree on a shorter period than that indicated in the previous paragraph, which may not be less than one year from delivery.

With regard to repairs and after-sales services, Article 127 bis applies:

  1. The producer shall, in any case, guarantee the existence of an adequate technical service and spare parts for a minimum period of ten years from the date on which the goods cease to be manufactured.
  2. It is prohibited to increase the prices of spare parts when applying them to repairs. The price list for spare parts must be made available to the public, as well as that for other related services, and the different items must be differentiated on the invoice.
  3. The action or right to recover goods delivered by the consumer or user to the business for repair shall expire one year after the date of delivery. Regulations shall establish the information that the business must provide when goods are delivered for repair and the means by which such delivery may be proven.
